If you have a successful track record in business and are prepared to invest upwards of $500,000 in a new business in Australia there is a range of options available.

There are many different types of visas. Provisional visas allow the visa holder to settle in Australia for the purposes of establishing a business. These visas are intended for people who can demonstrate that they have a significant business career and who are willing to obtain a substantial ownership interest in a new or existing business in Australia. All applicants for business skills visas, with some exceptions, must first apply for a provisional business visa. After successfully operating a business, or maintaining an investment, for between 2 and 4 years such people are eligible to apply for a permanent business skills visa.

The following lists the most common visas within this stream:

  • Business Owner (Provisional) - Subclass 160 Applicant must be aged 44 or less at the time of application and have had a business with a turnover of not less than $500,000 for at least two of the four fiscal years before  
  • State/Territory Sponsored Business Owner (Provisional) - Subclass 163 For successful business owners aged 54 and under who intend to establish and operate an eligible business.
  • Senior Executive (Provisional) - Subclass 161 For successful business owners and senior managers aged 54 and under who intend to establish and operate an eligible business. .
  • State/Territory Sponsored Senior Executive (Provisional) - Subclass 164 For people aged 54 and under who have worked in the top three levels of management in a major business (with a turnover of at least A$10 million) who intend to establish and operate a business.
  • Investor (Provisional) - Subclass 162
  • State/Territory Sponsored Investor (Provisional) - Subclass 165 For people who have a successful business/investment record, who are aged 54 and under and make an investment of A$750,000 (or A$500,000 for regional locations) with the state treasury for a four-year period and are prepared to engage in ongoing, non-passive investment/business activity. 
  • Business Talent - Subclass 132 For high calibre business people generally aged 54 years and under who can demonstrate outstanding commercial achievements and are proposing to establish a significant business which will be of exceptional economic benefit.

Each state and territory in Australia has its own office to support prospective migrants. Different rules and application procedures apply. All authorities will look for a genuine commitment to settle in the state or territory and in the cases of Tasmania and the ACT, for example, prospective business migrants are required to have visited in person in advance of making a sponsorship application. There are other visas such as the 457 that are referred to as long-term business visas but are, in fact, visas that will enable you and your dependants to stay in Australia for periods up to 4 years so long as you have been sponsored by an Australian employer. These visas come with some strict conditions and do not offer permanent residency. It is important that you are aware of the range of restrictions and rules before you apply for a visa of a particular class.
